The Howard Family came from England in 1770, and William Howard, great-grandfather of Robert A. and Ezekiel, the grandfather, were soldiers in the Revolutionary war.

Photocopies and Transcription made 11 Feb 1986 by Dorsey A. Howard, a descendant of Rev. Elder William Howard & his Wife, Hannah Psalter, parents of Ezekiel Howard, through their son, Hiram Howard, whose signature appears on this will as a Witness.

Note that some family tree records show a son, William, for Ezekiel and his wife, Rebecca Anderson Howard.

If there indeed was a son he was obviously not living when this will was written since he is not mentioned. Note that Ezekiel's wife, Rebecca, was deceased prior to the writing of this will.

"In the name of God amen. I Ezekiel Howard of Montgomery County, Virginia, now having arrived to aged years and attended with Bodyly Infirmity But of sound mind and Disposing memory for which I acknoledge the Blessings of God and Being mindful of the uncertainty of Human Life and Desirious of disposing of all such worldly estate as it hath pleased God to Bless me with I Do hereby make and constitute this my Last will and Testament in manner and form following (Viz)

...First I give to my Two sons Alexander and Anderson Howard all the right Title and Intrust of my Home plantation on Mill Creek - excepting the part I sold and Conditionally Conveyed to Elias Skelton agreable to a Conditional Conveyance recorded in the clerks office and a Tittle Bond dated 13th April 1818 and my sd. Two sons are Hereby authorized and required to execute such Title to E. Skelton His Heirs & e. whenever the conditions contained in the Sd Bond is complied with on the part of Sd Skelton His Heirs & e.

...I also give to my Sd Two Sons Alexander and Anderson all and every part of the Ballance of Two Tracts of land situate as follows (Viz) one parcel Lying on the Little Poplar Branch on the north side of the pilot mountain conveyed to me by Deed from William Howard part of which is conveyed to Abner Dobins.......The other parcel being the Ballance of an Inclusive survey of 455 acres Situate on the Head Waters of mill creek. Some part of the same Tract is conveyed by Deed to Arch I. Thompson - John Thompson, Samuel Thompson, Jacob Acres and James Simpkins- also one other Tract of 460 acres Situate on the south side of the alum bridge (or ridge)already Described in a Deed to them......The whole of the above mentioned Lands Together with the Tenaments and appurtinincies Thereto belonging (except the part sold to the Sd Skelton) To be equally Divided between the Sd Alexander and Anderson Howard their Heirs & e.

...Third, I give to my son Anderson a negro man slave named Lewis for the use of him and his Heirs forever.

...Fourth, I also give to my son Alexander a negro Boy - named Grandvill- But he is required to pay over to my Daughter Margerett her Heirs & e. the Sum of one Hundred Dollars in three years from the present Date .

...Fifth, I also give to my Daughter Sophia a negro boy named Franklin to Inherit During her life and the life of her present Husband John Calfee and her children forever any She Shall have - if not to Descend to the children of my Daughter Evelinia if she shall have any, But if neither of them leave any Child - the Sd Slave to be inherited by the children of my Daughter Margerett.

...Sixth, I give and Bequeath to my Daughter Peggy or Margerett a negro Boy named Nelson for the use and Benefit of her and her Children forever - and also I give to my Sd Daughter Margerett and her Heirs one Hundred Dollars cash to be paid by my Son Alexander in three years from Date.

...Seventh, I also give to my Daughter Evelinia and her children forever a negro Boy named Charles on condition that she her Heirs or Legal Representative pay over To my Daughtor Juliett her Heirs or legal representative at the expirration of Five years the sum of Forty Dollars..

...Eighth, I give to my Daughtor Rebeckah and To her children forever a female Slave named Nancy or Ann Thirteen years old and all her Issue.

...Ninth, I also give to my Daughtor Juliett a female Slave named Nancy and all her issue to Divolve on her and her children forever and also I give to my Sd Daughtor Juliet..Forty Dollars to be paid at the expiration of five years by the representative of my Daughter Evelinia.

...Tenth, I give to my Sd Daughtors namely Sophia, Margerett, Rebeckah, Evelinia and Juliett the Benefit of obligations against Elias Skelton and Moses Skelton amounting to nine Hundred and fifty Dollars to be equally Divided among them their Heirs & e. (Viz) Two obligations against Elias Skelton of Two Hundred Dollars each bearing date 13th. April 1818 and one of Sixty Dollars Dated 22nd.May 1821 and one of Forty Dollars bearing Date 4th. January 1824. Also three obligations vs Moses Skelton and Elias Skelton of one Hundred and fifty Dollars each bearing Date 22 May 1821. But the following conditions is hereby expressly reserved (Viz) if the Sd Elias Skelton and Moses Skelton their Heirs & e. shall pay satisfy and fully Discharge the amount of the above obligations principle and Interest Thereon when the same is paid...excepting thereout one Hundred and Twenty Dollars principle and Interest Due when the last money is paid then the Sd Elias and Moses Skelton Shall be exonerated from the payment of any more money - provided the amount of the above obligations principle and Intrust Shall be fully Discharged and paid over to the above named claiments or their Legal Representative or agents in the County of Montgomery on or before the first Day of October one thousand eight hundred and Thirty Two ...I hereby give to the Sd. Elias Skelton a Remitance out of the above obligations of one Hundred Twenty Dollars by his complying with the above express Condition...the above condition is not to Impede the Collection of the above notes as they come due except the $120 Dollars - untill the 1st. Oct. 1832. All properties conditionally sold to Elias Skelton is reserved as security for the payment of obligations Indulgence. Sd. Elias Skelton is Recommended to my Heirs,

...Eleventh, When my Two Daughters Rebeckah and Juliett shall arive to the age of Twenty one years or marry, I allow them to Have property out of my personal estate Equal those already married (Viz) each a horse beast Saddle and Bridle Including the saddles they now have each two cow beasts and Half a Dozen sheep each a Table and chest and exclusive of Descent Cloathing, a good Bed and furniture Cupboard ware and Bible.

...Twelfth, After all my Just Debts and funeral expenses are paid I give all of the Residue of my personal estate to my Two sons Alexander and Anderson Consisting of money Debts Due and to become Due, goods and Chattels of every Discription to be equally Divided between them by agreement without any appraisment Sale except I give my Sd Daughtors fifty Dollars Ready Cash $10 each.

...Thirteenth and Lastly I Constitute and appoint my sons Alexander and Anderson and my Son in law John Calfee at Reed Island in Wyth County Joint Executors Heirs & e to Carry Into effect this my last will and Testament hereby Revoking all others - and as there will be no sale of property, no appriasment will be necessary as all my estate Real and personal is Devised and the delivery of the above mentioned oblagations to the claimants or their Legal Representatives Shall exhonerate the executors which may be Done by agreement or else the money collected and paid over.

...by Bond and Securities shall be required to secure the payment of all Just claims and the Delivery of the Legacies...(illegible)
