Agnes was the first born daughter of James Stanley Emery and Mary Rice Emery. The 1900 census shows her living in Lawrence, KS with her mother and sister Sarah at 624 Louisiana St. Her father, James, died June 8, 1898. James was a member of the Leavenworth, Kansas constitutional convention and served on the Kansas Legislature in 1862 and 1863. President Abraham Lincoln appointed him U.S. District Attorney for Kansas in 1864. In 1891 he was president of the Kansas State Historical Society.

Cemetery records indicate that Agnes is buried in the section with other family members, but there is no headstone or other marker for her.
