KATHARINE PANKRATZ

A rather novel case was tried before Justice A. Wallich in this city on Tuesday. It appears from the evidence that a Catholic priest named Nicholous Gaellweiler, who presided over a congregation in the Town of Kossuth objected to the presence in his church on a recent Sunday of Catherine Pankratz, a sister of Mr. Geo. Pankratz of this city and a highly respected resident of that town and stopped in the middle of the sermon to request her to leave the building. Miss Pankratz inquired into the cause of this remarkable request and received no satisfactory answer, refused to go. The priest then called upon a trustee of the church, one Jos. Augustine, too put her out. Augustin advanced to where the lady was and also requested her to go, she again refusing. The priest then announced that the services would be concluded at his residence, nearby, and the congregation dispersed. Finding Miss P. still in her seat, he took her by the arm and forcibly ejected her from the building again calling upon Augustin, who was met at the entrance, to put her outside of the church yard, which he proceeded to do. Miss Pankratz entered a complaint of assault and battery against the two men. Augustine pled guilty and paid a fine and costs amounting to $23 and on Tuesday the priest was arrested. The jury before whom the trail occurred returned a verdict of "guilty" and the justice fined the saintly bulldozer $10 and costs amounting to $57 more. By his attorney he appealed to the Circuit Court, gave bonds for his appearance and thus the matter rests. The evidence submitted failed to show any reason why Miss Pankratz should not be allowed to remain as she was quiet and ladylike in both her words and actions and occupied the vacant pew with the permission of the owners thereof. We can find no excuse for the ruffianly conduct of the priest and Augustin. Having publicly insulted and maltreated a lady, we hope he will be made to suffer the penalty and learn that the law has a stronger grip on a citizen than a bigot, be he Jew or Gentile, Catholic or Protestant.

Petition for appointment of a guardian for Mrs. Catherine Pankratz, and at the time a guardian was appointed, has recovered and has left her home on Fifteenth street. It is said that the woman left the house the day after the court had issued its order and has remained away in fear of being placed under restraint. Miss Pankratz is said to be possessed of $25,000.

Miss Pankratz Cannot Be Located By Guardian Named By Court


Refusing to submit to guardianship as ordered in probate court two weeks ago, Miss Catherine Pankratz cannot be located and it is believed that she is in hiding, pending preparation of a suit that is to started in her behalf to set aside the order of the court. Frank Hessel, Francis Creek, who was appointed guardian, has filed a bond for $40,000 as required and was in the city Thursday to accompany Miss Pankratz to his home where she was to be cared for. Efforts to locate the woman failed and it was reported to the court that action was to be taken to set aside the order and that Miss Pankratz was in hiding until such time as the papers could be prepared.

Report has been brought to Judge Chloupek, who issued the order, that Miss Pankratz had consulted attorneys and would contest the order for a guardian and the court will probably call in another judge if the action is started. Miss Pankratz, who was ill abed at the time a guardian was appointed, has recovered and has left her home on Fifteenth street. TAKE STAND IN OWN BEHALF
Miss Pankratz Denies That She is Incompetent


Declaring that she has full knowledge of all her business affairs and giving facts and figures relative to the disposition of her property and monies, Miss Catherine Pankratz, in probate court today testifying in her own behalf, sought to convince the court that she is fully competent to care for her person and property.

Judge Krez, of Sheboygan was called to hear the case and a large number of witnesses are in attendance. Miss Pankratz declared that she is 78 years of age, came here when she was 25 and said that the only illness with which she is afflicted is a cough which bothered her but little.

Wm. Rahr and Frank Hessel, testified in her behalf also. The testimony on the petition to continue the guardianship was the same as presented at the previous inquiry, showing the condition in which the woman was found by the authorities. Dr. Max Staehle, health officer and a neighbor, Mrs. Barbara Goetzler and others testified.

Judge Krez declared that the premises might be steeped in filth and conditions be revolting but this fact would not prove the woman incompetent to care for her person and money. The case is still on.

COURT DECLARES HER COMPETENT
Sheboygan Judge Says Miss Pankratz Is Competent, Discharges Guardian


Ordering the discharge of the guardian, Judge Paul Krez, of the Sheboygan county probate court, has adjudged Miss Catherine Pankratz, of this city, competent and she will be reinstated to possession of her property which she will have the personal management of in the future. The order of the court discharging F. Hessel as guardian was filed Wednesday but the findings of the court and the formal decision has not been recorded.

Under decision of the court, Miss Pankratz, who is 78 years of age, is held to be fully competent to care for her person and property and the order of Judge Chloupek for a guardian is set aside. The case was heard on a petition filed by Miss Pankratz asking that the first order be vacated and that she be restored to her property rights. In the case she was aided by relatives who are said to have been opposed to the guardian in person.

It was said at the time of the hearing that Miss Pankratz would make her home with relatives but she has persistently refused to do this. She owns a house on 15th street and may return there though the place was said by the court in the first hearing not to be a fit place. It is probable that there may be some new developments in the case.

Aged 78, Found Living in Shack with Queer Surroundings and Asked City for Auto to Deliver Washing


Manitowoc, Wis., March 29 (special)
Judge Kriz of the Sheboygan county court has discharged the guardian and declares Miss Catherine Pankratz, aged 76, of this city, competent and restores to her possession of her property and rights. The decision results from a petition of the woman for setting aside of the judgment of Judge Chloupek of this city, declaring her incompetent to manage her property, valued at $35,000 or more. Miss Pankratz was found living in a shack with twenty pairs of mismatched shoes, a dozen loaves of stale bread and the house in disorder and filth, but the court says that this was no indication that she is not competent. Many are the report which have been issued about the woman. One was to the effect that she asked the city poor department to furnish her with an automobile with which she could deliver washing. It was stated that she presented the authorities with a picture of the automobile she would prefer.

DEATH CLAIMS AGED RESIDENT OF THE COUNTY

Death claimed Miss Kathryn Pankratz, an aged resident of the county, at the home of her nephew, Charles Hessel, at Francis Creek and the funeral will be held the Catholic church there Saturday morning.

Miss Pankratz was 86 years of age and had been a resident of the county for many years. She was born in Germany April 9, 1829.

Deceased was a sister to the late Mrs. Kellner, and is survived by a brother, Michael Pankratz, of Cato and a sister, Mrs. Blimel of Kossuth.

Her death was due to infirmities of old age.

Notice is hereby given, That at a special term of the county court to be held in and for said county at the court house in the city of Manitowoc in said county on the fifth Tuesday (being the 30th day) of May, A.D., 1916, at the opening of court on that day the following matter will be heard and considered:
The application of Charles Hessel, executor of the will of Katherine Pankratz, deceased, late of Kossuth in said county, for the examination and allowance of his final account, and for the assignment of the residue of the estate of said deceased to such persons as are by law entitled there to; and for the determination and adjudication of the inheritance tax if any, payable in said estate.

WILL ASK COURT TO AUTHORIZE A CONTEST ON WILL
Petition to be Made in Circuit Court for Contest on Will of Late Catherine Pankratz. Now Probated


Attorneys have been retained and petition will be filed in circuit court by relatives asking permission to institute a contest on the will of the late Mrs. Catherine Pankratz, whose estate has practically been settled in probate court by probating of the will and administration.

The petition, it is said, will be filed by Mrs. Barbar (sic) Kellner, a sister of the decedent and other heirs may join in the case.

Mrs. Pankratz died two years ago, leaving an estate valued at $11,000. Mrs. Kellner received $100 and small bequests were made to other relatives, the bulk of the estate going to the children of Charles Hessel and M. Pankratz, the former a friend and the latter a brother of the decedent.

Mrs. Pankratz had made her home with the Hessel family previous to death. Hessel and Pankratz were named executors of the will but two weeks after will was filed, Mrs. Pankratz died, and Mr. Hessel acted as administrator. No contest was raised on the will when it was presented for probate and the estate is now settled, the administrator having filed his final accounting. Because of this fact it will be necessary for the petitioners attacking the will to secure permission from circuit court in which court the matter will be taken up.

Mrs. Pankratz was an eccentric woman and at one time was adjudged insane by Judge Chloupek in probate court. Later, upon a rehearing, Judge Paul Krez of Sheboygan held that she was sane and dismissed the petition.

Representatives of the firm of Martin & Martin at Green Bay who have been retained in the contest are here to institute proceedings.
