He was 74 years of age, having retired from the bench on December 4, 1938, upon attaining the retirement age. He had served 29 years as Chief Judge of the Sixth Judicial Circuit, gaining unusual recognition as an Association Judge of the Court of Appeals as well as in the performance of his duties here.
Although apparently in good health, Judge Urner had been seriously disturbed by the illness of his wife. Mr. Urner has been ill for some time and was a patient at the Frederick City Hospital prior to going to the Baltimore hospital.
In addition to his wife, he is survived by three sons: Joseph W. Urner, this city; Francis H. Urner, Pittsburgh; and Martin J. Urner, Hagerstown.
Funeral arrangements were by the M.R. Etchison and Son funeral home.
