The California Highway Patrol was formed in 1929 and Officer Pence became the 122nd CHP officer killed in the line-of-duty.

On April 6, 1970, Officer James Pence, ID #6885, along with three other CHP officers, was killed in a four minute gun battle that has since been called "The Newhall Incident."

The other Highway Patrol officers killed at teh Newhall Incident were:
Officer Roger Gore
Officer Walter Frago
Officer George Alleyn.

Officer Pence was 24 years old.

On August 11, 2006, the state of California named a portion of Interstate 5, between Rye Canyon Road and Magic Mountain Parkway, in Los Angeles County, the "California Highway Patrol Officers James E. Pence, Jr., Roger D. Gore, Walter C. Frago, and George M. Alleyn Memorial Highway."

Officer Pence's name can be found at the National Law Enforcement Officer's Memorial, in Washington, D.C., on Panel 21, W-1.
