William Waightstill was the oldest son of Isaac Thomas Avery and Harriet Eloise Erwin. He was the valedictorian of the University of North Carolina graduation in 1837. He became a lawyer. In 1851, an incident occurred in which Avery was horsewhipped by a man because of Avery's defending his opponent in a lawsuit. Avery was defenseless. When the man appeared in court again, Avery shot the man dead. He was aquitted on grounds of "extreme provocation leading to temporary insanity". Avery continued his law career. Avery died on July 3, 1864 when he was wounded during the coming of Kirk's Raiders.
