During the Civil War, he served two weeks with an unknown emergency militia unit during the crisis that culminated in the battle of Antietam. His unit saw no action and never left the state.

Samuel Hepburn, Jr. was married twice. His first wife, Maria Parker Moore, died in 1870. He soon remarried to Marie Josephine Japy. There were two children from the first marriage: Maria (1865-1869) and Samuel (1867-1904). Six children were born to the second marriage: Charles Japy (1872-1942); William Williamson (1873-1947); Louis Frederic (1875-1932); Arthur Japy (1877-1964); Marie Louise (1879-1964); and Donald McKnight (1881-1936)

"SAMUEL HEPBURN, JR. DEAD
BRILLIANT LAWYER EXPIRES ON A STEAMSHIP BOUND FOR FLORIDA.
Carlisle, March 29.-- A telegram received here at noon announced the death of Samuel Hepburn, Jr., aged 50, on board the steamer Iroquois, off the coast of South Carolina, while on the way to Jacksonville, Florida, for the benefit of his health.
He left here last Monday, accompanied by his son Charles, a young man, who is a student at Dickinson College. He has been in ill health for some time, but no one surmised there was any danger. The message says he died of apoplexy. He was a brilliant lawyer and one of the best known men in this part of the State, having a large practice in both the lower and Supreme Courts. His body will arrive here Monday night."
