Rosetta J Allen vs John B Allen
In Chancery
It appearing to the Court from the papers herein that an order of publication was duly taken at Rules against the defendant John B Allen, and that the same was duly published and posted according to law, and this cause having been material at Rules and set for hearing come on this day to be heard on the bill and exhibits therewith filed and depositions duly taken in behalf of the plaintiff and filed herein, and was argued by council.
And it appearing to the Court that the allegations of the plaintiffs bill herein are fully proven and that the plaintiff Rosetta J Allen is intitled to the relief prayed for in said bill, the said defendant having willfully deserted and abandoned the said plaintiff for more than three years prior to the bringing of this suit.
It is therefore adjudged, ordered and decreed that the bonds of matrimony heretofore solemnized between the said Rosetta J Allen and John B Allen be dissolved and that the said Rosetta J Allen be granted a divorce a vinculo matriononie from the John B Allen.
(According to some of the depositions given, John B. Allen deserted Rosetta and their children September 9 1893.They had not lived together for 5 years. She was living in Jimtown in 1893.)
John and Rosetta had the following children:
Thomas Gilmer Allen (1884-1971)
Ona F. Allen (1887-1981)
Lucy Matilda Allen (1888-1903)
