While serving as a posse member, he was shot and killed by Earl Durand, an escapee from jail
who also killed Deputy Sheriff David Baker; Town Marshal Charles E. Lewis; and Posseman Orville Linaberry. The suspect was killed while trying to rob a bank in which a hostage John Gawthrop was also killed.
