Mother - Ruth (Child) Fay

Husband of Mary (Staniford) Fay

Vermont Supreme Court Judge. He was a "Fifer" in the Battle of Bennington, then only about 15 years old. He was afterwards a lawyer, admitted to the bar in June 1794, was Vermont State Attorney four years before 1801, United States attorney under U.S. President Thomas Jefferson, Judge of the Vermont Supreme court 1809 to 1813 and Judge of Probate 1819 & 1820.

The Fays were active members of the Masons. David and his brothers, Jonas and Joseph, are all cited in records associated with the second Masonic Lodge in Vermont, the "North Star Lodge." This second lodge was chartered by the St. Andrew's Lodge of Massachusetts in January 20, 1785.
Infamous Paul Revere was a leader in the St. Andrew's lodge and signed the charter documents for the North Star Lodge. (Tillotson, 1920)
In Tillotson's book Ancient Craft Masonry in Vermont the Fays are highlighted. The following is taken from his book that is cited below.
"DAVID FAY: Member of the Council of Censors 1799 to 1806 and Judge of the Supreme Court [Vermont] 1809 to 1812. He was United States District Attorney un the administration of U.S. President Thomas Jefferson." P. 32
"DR. JONAS FAY: Brother of David Fay: was a member of the Commission to Congress in 1775, 1777, 1779, 1781, and 1782, for the purpose of negotiating for the admission of Vermont to the Union. He was Judge of the Supreme court [Vermont] in 1782." p. 32
