Eugene Moore along with Sheriff Maxwell were keeping tabs on a open air bandstand where music and goodtimes were flowing. They saw a vehicle approach that they did not recognize, so they went to investigate. Seeing one of the occupants drinking whiskey, Sheriff Maxwell announced "you can consider yourself under arrest." Suddenly the car roared to life and bullets were flying. One of which hit Deputy Moore before he could pull his gun from his hoster. He died preforming his duty. The killers,Clyde Barrow and Raymond Hamilton, and Ross Dyer escaped.
