In June 1861 he was commissioned a captain by Governor Letcher and authorized to raise a company of artillery. On June 27, 1861 Captain Binford advertised in the Richmond Dispatch that he needed 22 men and officers to complete the company. By July 5 he had 45 men and officers on the roll. However, on August 29, 1861 the company was disbanded by order of the Governor because it was still under strength.
