Southern Campaign American Revolution Pension Statements Pension application of James Martindale R6979 A Mary fn76SC Transcribed by Will Graves last rev'd 6/16/09 State of Ohio, County of Gallia On this 13th day of August A.D. 1832 personally appeared in open court before the judges of the Court of Common Pleas for Gallia County now in session, James Martindale, a resident of Addison Township in Gallia County, State of Ohio, aged Seventy Eight years, who being first duly sworn according to law, doth on his oath, make the following declaration to obtain the benefit of the act of Congress passed June 7, 1832. That he entered the service of the U. S. under the following named officers and served as herein stated. That he volunteered as a private soldier in the South Carolina militia for one year, does not recollect the year. Officers: Colonel Thomas Branon [sic, Thomas Brandon] – Lieutenant Colonel Wm Lure [sic, McClure?], Captain William Young;1 that he was occupied mostly against the Tories in that State – was at the attack on the Fort at 96.2
2nd : That he afterwards volunteered again in the same company and Regiment, as a lieutenant having as before for his Captain William Young, Colonel Thomas Brandon. He at this time was mostly engaged in putting and keeping down the Tories, was in numerous encounters with the Tories but cannot recollect particulars. He was at the attack on Colonel Ferguson [sic, Major Patrick Ferguson] on King's Mountain who was there defeated.
That he recollects Colonel Thomas' Regiment of Militia being there, and that General Green [sic, Nathanael Greene] of the regular service commanded the whole attack. That at this time he was resident in Union County State of South Carolina.

He hereby relinquishes every claim whatever to a pension or annuity except the present, and declares that his name is not on the pension roll of any agency of any State.
He has no documentary proof. At this time he was resident in Union County South Carolina. He does not recollect the length of time, but knows was more than two years that he was out on this last service.
S/ James Martindale, X his mark Sworn to and subscribed the day and year aforesaid August term 1832. S/ Francis LeCleriq [?], Clk. C. C. P. G. C. We James Guy 2nd and Adam Fillmore residing in the said township of Addison hereby certify that we are well acquainted with James Martindale, who has subscribed the above declaration; that we believe him to be 78 years of age; that he is reputed and believed in the neighborhood where he lives to have been a soldier of the revolution who above declares; and that we concur in this opinion. S/ James Guy, 2nd S/ Adam Fillmore Sworn and subscribed the day and year aforesaid -- August Term 1832 S/ Francis Leclerig [?], Clk, C. C. P., G. C. Interrogatories: 1st Where and in what year were you born? 1754 [?] in Pennsylvania, Bucks County 2nd Have you any record of your age? Have none 3rd Where were you living when called into service, where [have you lived] since the revolutionary war, and where do you live now? When I entered [I lived] in Union County – State of South Carolina – from thence after the war removed to Bedford County Virginia – thence to Greenbrier County Virginia – thence about 23 years ago I removed to this State into Addison Township in Gallia County – where I 1 William Young W10008 2 The Siege of the fort at 96 by the Whigs occurred in the late Spring of 1781. 3 The Battle of King's Mountain occurred on October 7, 1780.
now reside. 4th How called into service? I volunteered. 5th State the names of some of the regular officers who were with the troops where you served etc.? I recollect only General Greene of the regulars who was at Ninety Six with our Regiment and Colonel Thomas' Regiment of South Carolina militia. We had but very little intercourse with the regulars. 6th As a soldier did you receive a discharge from the service? I did not 7th As an officer did you ever receive a commission; and if so by whom was it signed, and what has become of it? I had a commission, it was signed by General Pickens he thinks, after the war I considered it of no account and it was lost. 8th State the names of persons to whom you are known in your present neighborhood, and who can testify as to your character and veracity and their belief of your services as a soldier of the revolution? I am known to John Switser [?], Philip Switser [?], James Guy. He knows not whether any are living in his present neighborhood who are alive to testify. General Lewis Newsom of Gallipolis, Gallia County, Ohio knew him when in Bedford Virginia. And the court do hereby declare their opinion after the investigation of the matter, and after putting the interrogatories prescribed by the War Department that the above named applicant was a revolutionary soldier and served as he states. And the court further certifies that it appears to them that James Guy, 2nd and Adam Fillmore who have signed the same are resident in the same township and are creditable persons and that their statement is entitled to credit. The State of Ohio, Warren County On this fourth day of June 1833 personally came before me an Acting Justice of the Peace within and for the County aforesaid William Martindale4
That he does not now recollect the length of those tours, but that the one which was the last tour was two months (the one particular above referred to) but that he served several other tours in the same Company with him previous to his election and further deponent saith not.
a resident of said County who being duly sworn according to law deposeth and saith that he is upwards of 80 years of age, that his brother James Martindale who has, or is about making application for a pension is now about 82 years; that some time during the progress of the revolutionary War the said James was duly elected and served as a Lieutenant in the Company commanded by Captain William Young in Union County South Carolina; that this deponent was at the election, but does not know that he ever saw his commission, but knows that he performed at least one tour of duty in actual service; that this deponent served in the same Company with him which was commanded by Captain William Young in the Regiment commanded by Colonel Brandon; does not recollect the precise time or date. That he knows from information that his brother served several other tours in the capacity of Lieutenant, some of which were by a voluntary offer of his services and others by a regular draft – deponent also recollects that said James Martindale performed several tours in actual service previous to his election to the office of Lieutenant.

The State of Ohio Warren County: On this 4th day of June 1833 personally appeared James Martindale who being duly sworn according to law deposeth and saith that he is the identical person named in the preceding deposition of William Martindale and that he was elected and duly commissioned a Lieutenant in a company of militia in union County in the State of South Carolina in a company commanded by Captain Young that he does not now recollect the precise date, but thinks it was rising 2 4 FPA R6980
years before the termination of the Revolutionary War. That he held his commission in the same company after the termination of the War until he removed from the neighborhood which was about 2 years. At which he deemed the Commission of no importance and that it was lost or mislaid and further this deponent saith not. Sworn to & subscribed before me the date above written. S/ W. a Resident of said County who being duly a firm but according to law deposeth and saith that he is upwards of 76 years of age that James Martindale who is about making application for a pension is now about 82 years of age that some time during the Revolutionary war the said James Martindale was Lieutenant in the Company commanded by Captain William Young in the Union County South Carolina deponent saith that said Martindale served one tour of duty in actual service with him in the Company of George Avery in the Regiment commanded by Colonel Brannon [Brandon] at the siege of Ninety Six does not recollect the precise time or date and further this deponent saith not.

[fn p. 71] And additional affidavit in the matter of James Martindale application for a pension State of Ohio Gallia County Personally appeared before me, the undersigned, a Justice of the peace in and for said County, James Martindale, who being first duly sworn, deposeth and saith that by reason of old age and the consequent loss of memory, he cannot swear positively as to the precise length of his service, but according to the best of his recollection he served not less than the periods mentioned below, and in the following grades: For one year, I served as a private, as stated more at-large in first application. For 2 years and 6 months, I served as Lieutenant, as set forth more at-large in the first original paper. And for this service I claim a pension.
