In the name of God Amen; I Theophilus Moore of the County of Edgecomb and State of North Carolina being of sound mind and memory and considering the uncertainty of this frail and transitory life do therefore make, ordain, publish and declare this to be my last will and testament that is to say
First – After all my lawful debts are paid and discharged the residual of my estate real and personal I give, bequeath and dispose of as follows to wit: To my beloved wife all the track of land where I now live her lifetime or widowhood and one bed and furniture, two hundred weight of pork and tow barrels of cord. Second I give my son Stephen Moore fifteen dollars and third I give my son Theophilus Moore fifteen dollars if living at my death. Fourth I give my son Isaac Moore 1 crop cut corn. Fifth I give my home track of to be divided between my three daughters, Susannah, Milly and Elizabeth Moore after the death of me and my beloved wife, their lifetime and after their death to be sold and equally divided between my loving children.
Sixth, the balance of my property if any to be sold and equally divided among my living children. Likewise I make constitute and affirm my said sons David and Theophilus Moore executors to this my last will and testament herby ???? all former wills by me made ?? ?????? where of I have here unto subscribed my name and affixed my seal the twenty fifth day of December in the year of our Lord one thousand eight hundred and fifty four.
NOTE: Son David Moore although an Executor in the will contested the will in the Edgecomb Courts, the will was upheld, Theophilus Jr. became the only Executor.
