The following was excerpted from the Grand Jury Indictment in the case of Republic of Texas v. Mason B. Foley for the murder of Jasper "Sargeant". Transcribed on Feb. 24, 2014 by postkrispykritters, as written and without punctuation, from a copy of the original handwritten indictment.

The Republic of Texas
County of Colorado

In the District Court at November Term in the year of our Lord one thousand eight hundred and thirty nine.

In the name and by the authority of the Republic of Texas The Grand Jury to wit Frederick Scranton Foreman John Toliver William David E (space) ??Perry John L Gilder Jasper Gilbert Eli Clapp Barton M Daugherty Samuel J Ridgate Alexander Jackson Asa Townsend Johnson Roselle John Smotherd James Burlison John Crier Priston Gilbert John Cheney and Stapleton Townsend impaneled (illegible) and charged to (illegible) for the body of the county aforesaid upon their oath present that Mason B. Foley late of the county aforesaid in the county aforesaid Gentleman not having the fear of God before his eyes but being moved and seduced by the instigation of the Devil on the tenth day of November one thousand eight hundred and thirty nine with force and arms in the county aforesaid in and upon one Jasper Sargeant in the peace of God and of the said republic then and there being feloniously willfully and of his malice aforethought did make an assault and that the said Mason B. Foley a certain pistol of the value of ten dollars then and there loaded and charged with gunpowder and one leaden bullet which pistol he the said Mason B. Foley in his right hand then and there had, and held to against and upon the said Jasper Sargeant then and there feloniously willfully and of his malice aforethought did shoot and discharge and that the said Mason B. Foley with the leaden bullet aforesaid out of the pistol aforesaid then and there by force of the gun powder and shot sent forth as aforesaid the said Jasper Sargeant then and there feloniously willfully and of his malice aforethought did strike and penetrate and wound giving to the said Jasper Sargeant then and there with the leaden bullet aforesaid so as aforesaid shot discharged and sent forth out of the pistol aforesaid by the said Mason B. Foley in and upon the said right side of the head of him the said Jasper Sargeant one mortal wound of the depth of six inches of which said mortal wound the said Jasper Sargeant then and there immediately did die And so the Jurors aforesaid upon their oath aforesaid do say that the said Mason B. Foley the said Jasper Sargeant and manner and form aforesaid feloniously willfully and of his malice aforethought did kill and murder against the peace and dignity of the Republic
