RENO SALESMAN ARRESTED AFTER CHILD HOSPITALIZED

An unemployed Reno salesman was arrested Thursday night after taking his girlfriend's unconscious 2-year-old son to a hospital, Reno police said. Gerald M. Curtis, 31, of 1255 Silverada Blvd., is held for investigation of child abuse. His bail is $1,000.

Kenneth T. Butler, son of Maria L. Butler of the same Silverada address, is listed in very serious condition in the intensive care nursery at Washoe Medical Center. Police said a doctor diagnosed a massive cerebral hemorrhage, but, police said, the child exhibited no external injuries.

They said Curtis took the child to Saint Mary's Hospital, from which he was transferred to Washoe Medical Center. St. Mary's notified the police.

According to juvenile officers, Curtis was home alone with the victim and the latter's brother Richard, 3. Mrs. Butler is employed as a dealer.

Police said the injured child is not able to breathe by himself, and that his body temperature is being maintained by heat lamps. The case in under investigation.

CHARGES FILED IN YOUNGSTER INJURY CASE

The Washoe district attorney filed charges Monday against a Reno man suspected of critically injuring a Reno tot Thursday night. Officials of Washoe Medical Center reported Monday that two-year-old Kenneth T. Butler remained in critical condition with extensive brain damage.

Meanwhile, gross misdemeanor charges of child abuse and battery causing substantial bodily harm were filed in Reno Justice Court against Gerald M. Curtis, 31.

Police said the child suffered a massive cerebral hemorrhage when at home with Curtis at 1255 Silverada Blvd. Police said they arrested Curtis after he took the child to the hospital.

Curtis was in custody Monday night with his previous $1,000 bail raised to $5,000 by Justice of the Peace William Beemer.

MAN RE-BOOKED IN YOUNGSTER'S DEATH CASE

Gerald M. Curtis of Reno has been re-booked for investigation of murder in connection with the Thursday death of 2-year-old Kenneth Butler, Reno police said.

An autopsy Friday revealed the son of the man's girlfriend died of brain damage caused by blunt force trauma. Deputy Washoe County Coroner Ralph Bailey said that preliminary finding will be followed by a more detailed one.

Curtis was previously charged in a complaint with child abuse and battery causing bodily harm. District attorney Larry Hicks said he will complete his investigation of the case after receipt of the formal written autopsy report.

Reno police Thursday took Curtis from the Washoe County Jail to their own for re-booking. He then was returned to the county jail, where his bail was increased from $5,000 to $25,000, the jail commander said.

Police juvenile officers are not sure exactly how the child was injured, they said. Police arrested Curtis when he took the boy to the hospital October 16. A doctor at the time had diagnosed massive cerebral hemorrhage, police said.

According to the police report, Curtis had been home with Kenneth and older brother Richard, 3. The children's mother Maria, a 31-year-old dealer, was not home. The woman and children shared the residence at 1255 Silverada Blvd. with Curtis.

Police said the injured child, when admitted to Washoe Medical Center, was unable to breathe by himself.

The boy is survived, in addition to his mother and brother, by his father, Richard Butler of Reno. A funeral will be held Monday at 2 p.m. in the Ross, Burke and Knobel Mortuary. Burial will be in Our Mother of Sorrows Cemetery.

TOT DEATH INDICTMENT RETURNED

Gerald M. Curtis, 31, was indicted on a charge of murder Wednesday night by the Washoe County Grand Jury. Curtis, an unemployed salesman, had initially been arrested in connection with the alleged beating of 2-year-old Kenneth Butler, the son of Maria Butler, who resides with him at 1255 Silverada Blvd.

The child died October 23, and Curtis was re-booked for investigation of murder. Sources said Wednesday the Curtis case could develop into a test of the definition of death in Nevada.

RENO TRIAL VERDICT GUILTY

Prosecutor Cal Dunlap's closing oratory not only brought three jurors close to tears Friday, but also resulted in a first degree murder verdict against Gerald M. Curtis nearly 11 hours later, after a two week long trial.

Curtis, 32, was found guilty of killing 2-year-old Kenneth Todd Butler in premeditated murder. Washoe District Judge John Barrett set sentencing for August 31. Curtis can be ordered to spend the rest of his life in prison without the possibility of parole on the conviction.

The judge also gave Curtis' attorney, Public Defender Bill Puzey, an August 31 deadline for the filing of appeals or a motion for a new trial. Puzey said he would ask a new trial in the case.

With tears streaming down the faces of three women on the panel, Barrett sent the jurors into deliberation at about 3:45 p.m. Friday. They returned their unanimous guilty verdict at 2:30 a.m. today.

The dead youth was the son of Maria L. Butler and her estranged husband, Richard Butler. Mrs. Butler was living with Curtis at the time the boy was fatally injured.

Mrs. Butler's other son, Richard, has been taken from her by the Washoe County Welfare Department. She and her estranged husband currently are in a court custody battle over Richard, according to trial testimony.
