James Finnerty was commissioned and mustered in as 2nd lieutenant of Captain John B. Urmy's Company G, 3rd California Infantry, at Benicia Barracks, California, June 8, 1862. He was promoted to 1st lieutenant and transferred to Captain Josiah Hosmer's Company E, 3rd California Infantry, July 2, 1864. During his service in Utah Territory he protected the overland mail route. First Lieutenant Finnerty was discharged at Camp Douglas, Utah Territory, due to the consolidation of his regiment into a battalion of infantry.
