Elliott M. Braxton, 79, a pioneer resident of Newport News and well known as a practicing attorney here for many years, died at 8 yesterday morning at a hospital at Hot Springs where he had been ill for one week.

Mr. Braxton was associated with the legal department at the Newport News Shipbuilding and Dry Dock company plant here from 1900 until his retirement several years ago.

He came to Newport News in April 1891 after practicing law for two years in Washington, D.C. He qualified to practice before the supreme court of the United States and the supreme court of Virginia in 1899.

He was born Feb. 6, 1867 in Fredericksburg. His father was Major Elliott M. Braxton, and his mother, the former Miss Anna Maria Marshall. On his father's side. He was a descendant of Carter Braxton, one of the signers of the Declaration of Independence, while on his mother's side he was a lineal descendant of John Marshall, great chief justice.

He received his early education in the private schools of Fredericksburg and at Cleveland high school, Fauquier county. In 1884 he entered the University of Virginia, where he studied in the academic department two years. For two years he taught in a private school in Fredericksburg, and in 1887 he took the summer law course at the University of Virginia. He also read law in his father's office in Fredericksburg.

Mr. Braxton began his practice in 1889 in Washington with Gen. Eppa Hunton, and upon moving to Newport News in 1891 he opened an office here for practice of law. He was a member of the Newport News Bar association and the Virginia State Bar association. On Oct. 18,1893, he married Miss Janet Potter Fuller of Raleigh, N.C.

Surviving are one son, Douglas Marshall Braxton, of Chesapeake Ave., Boulevard; one sister Miss Mary Braxton of Fredericksburg, and two grandchildren, Elliott Muse Braxton, 2nd and James Philips Braxton, both of Newport News.

Funeral services will be held at 11 a.m. tomorrow in Fredericksburg. The family has requested that no flowers be sent.

Mr. Braxton was spending the month in Fredericksburg at the time of his illness. His son was with him at the time of his death.
