Lyons was suspect in a horse theft in Jackson County Jail, Oregon. He escaped and headed north to the Eugene area. On February 5, 1903 Lane County Sheriff Withers and a deputy attemped to apprehend Lyons at his home and Lyons and shot Sheriff Withers with a revolver in the neck. Withers died two days later. Lyons escaped after the shooting and remained at large for a short period of time, a reward of $1,000 was posted. After Lyons recapture he was tried, convicted and sentenced on March 6, 1903 to be executed by hanging. He was hanged on April 17, 1903 (from the time of the murder to the springing of the trap was only 70 days). The hanging took place in Eugene Oregon, within a stockade built outside of the Lane County Courthouse.
Lyons was the second and last man to be executed by hanging in Lane County, Oregon, the first was Claude Branton in 1899. It appears Lyons was buried in an unmarked grave in the pauper section of the graveyard.
