Dies in England – Kingstree, Aug 25 – Word has just been received here that Mrs Samuel S McCants of Washington, DC who spent several winters in Kingstree with her daughter, Miss Marion McCants, died August 4 in England, where she and her daughter were visiting relatives. Miss McCants was a member of the South Carolina Society, Colonial Dames, and had many friends and relatives in Kingstree.

The “Yearbook for St John’s Parish for 1917” 45, St John’s Archives notes that Miss Marion J McCants was elected Vice President of the Junior Auxiliary.

The Probate papers of Mrs Tallulah McCant’s estate stipulate that in 1928, Miss Marion J McCants was a resident of the LaFayette Hotel in Washington DC which at the time was located on 16th and K Streets NW, a short walk from St John’s Church. Marion J McCants was the sole beneficiary of her mother’s estate, which included over $20,000 in common stock. Within a month of Tallulah McCant’s death, her only other surviving child, other than Marion, Mr Melnotte McCants of San Francisco, California died at sea on September 4, 1928, leaving a wife but no children. Mr Melnotte McCant’s will of January 22, 1928, stipulated that, in the event of his death, his wife would receive $25,000, and the remainder of his estate was to be given to his mother, Tallulah McCants; to his sister, Marion J McCants; and to his wife, in equal shares. Miss Marion J McCants died in Washington DC in December 1969.

First Session of Fight Held in Spartanburg – McCant’s Divorce Case Hearing – To break up Will is object of Mrs Tallulah Mounce McCants – Her son also a Plaintiff in the Suit

With the taking of testimony yesterday before the master, says Wednesday’s Spartanburg Herald, another chapter was added to the complicated McCants case, in which an effort is being made to set aside the will of the late Samuel F McCants, in which he leaves a life interest in his estate to his 2nd wife, Mrs Janie M McCants on the grounds that his 1st wife, Tallulah M McCants is his lawful widow.

Statements made by Mrs Tallulah M McCants on the witness stand yesterday indicate that an attempt will be made to show that the divorce she obtained from Mr McCants in Virginia many years ago is not valid because Mr McCants was a resident of South Carolina and not amendable, therefore, to the divorce laws of Virginia.

It is the contention of Mrs Tallulah M McCants that she is Mr McCant’s lawful widow and that Mrs Janie M McCants was never his legal wife because South Carolina does not recognize divorce. ……

The title of the case is “Melnotte McCants, Plaintiff against Angelita McCants, and others, defendants.”

Melnotte McCants, the plaintiff in the suite, is a son of S F McCants by Mrs Tallulah M McCants. Mr McCants bequeathed most of his property to his sons, but his estate was charged with the support of Mrs Janie M McCants. Melnotte McCants alleges that too much of the estate is being used for the support of Mrs Janie M McCants and that she was not his legal wife and not entitled therefore, to more than one-fourth of his estate.

Mrs Tallulah M McCants testified yesterday as follows: I was Tallulah M McCants, daughter of Robert H Mounce of Abbeville, SC, before my marriage on April 20, 1871 to Samuel F McCants of Abbeville County.

After my marriage, I resided about seventeen or eighteen years in Spartanburg. I was married in the State of Alabama and came soon afterward to Spartanburg.

I and my children and my husband, left Spartanburg in 1883 and lived a while in Charleston – for three or four years.

My husband died April 23, 1909. I am his widow.

I had three children – Robert C McCants, Melnotte McCants and Angelita McCants. Robert died December 23, 1909. He left a widow, Lillian R McCants. She is living in Chicago, IL. My son, Melnotte, is married and living in San Francisco, CA”

Cross examined, she said: “I was living in Abbeville County when my husband deserted me – or rather, we had gone down to Charleston for a visit. I do not mean that I was living in Charleston and my husband was traveling for L C Younger of Richmond, VA. I stopped over in Columbia and was there with him several days. He left us there and I didn’t meet him again till I met him several years afterward in Richmond.

I think it was 1889 when I speak of meeting him in Columbia. In 1893, I went to Virginia to attempt to get a separation with support. From the time my husband left me in Columbia till I saw him in Virginia, my husband was contributing nothing to my support.” She proceeded to tell how she arranged with Philip B Shield, a Richmond Attorney, to receive money from her husband. For two years thereafter, she was given about $40 a month by shield, which she presumed came from her husband.

She told of accepting a position in Baltimore and of living there until 1893 when she went to Virginia, where she remained until 1895.

In reply to questions by Mr Greene, she said “When I went to Richmond in 1893, Mr McCants was not living there. He never lived there. I never heard of his living there a day of his life.”

Mr Carlisle offered in evidence a certified copy of the divorce decree.
Hearing adjourned.
