LAST WILL AND TESTAMENT OF BENJAMIN B. LANIER

I Benjamin B. Lanier of the County of Marshall & State of Tennessee being in my right mind & knowing that death is a broad in the service & that I must die & being desirous to settle my Business do hereby make & publish this my Last Will and Testament hereby revoking & making void all former Wills by me made at any time.

1st My will and desire is that my just debts shall all be paid as soon after my death as can be closed out of any moneys that may be and had at that time or that may first be collected that may in any way belong to my estate.

2nd My Will and desire is just after my debt is paid that my financial Expenses be paid as soon after my death as can be conveniently be done.

3rd My Will & desire is & I hereby give & Bequeath to my beloved Wife Mary Lanier my tract of land on which I reside at this time with all the appurtenances thereto belonging during her life on Wedaece Road also all my Negroes & all my stock of every description & all my farming utentials & grain of every kind that may be on hand at my death & all the household & kitchen furniture of every description shall by this my Will be and accrue to the use & benefit of her my said wife as above named during her life or widowhood for the specific purpose of her support & for to enable her to raise & support her family & my said wife Mary Lanier is freely liberated and permitted to sell & dispose of any of the

above named property at a fair and reasonable price for the benefit of her & her family with the Exception of the Land. She is not to sell or dispose of it & should it be thought advisable to sell a Negro or Negros there and in that case my said wife shall sell by and through the advice of my beloved Brother William Lanier if living & if he should be not living then she shall be advised by some person that is a bonified judge of the value of negros properly & when it is necessary to sell any other of this before named property my wish is that she shall be advised by James B. Scott & A. Laird if they or either of them is living & cass with conversation attend to the said matter but if not she shall act on her own judgment or advise with whom she pleases so as to make a fair sale at customary prices -------

4th I wish it to be distinctly understood that all the above named property as set forth is onley to be for the use of my said wife & her family during her life or widowhood & in case of the death or marriage of my said wife Mary Lanier that my Executor shall sell all of said property of every description that belongs to my estate at the time of her death or marriage as aforesaid & said property after being sold the effects thereof or moneys arising from the sale of the same shall be Equally divided amongst all my children or heirs at law & in case my said wife should be living & married then and in that case she shall be a joint heir in said estate & my said Executor shall pay and deliver to her her legasee or portion as above stated as soon as a reasonable time will permit for him to sell & Collect said proceeds & my wish & desire is that my negros have the privilege of choosing a Master or Masters for themselves provided that in so doing they can be sold for a fair price but not to have the privilege unless a fair price can be had from those they may choose & my Negro Man Jack may choose a Master to but him & his wife & children provided a fair and full value can be had for him & his family but not to have the right to choose in any other consideration than above named --------

5th My Will and desire is that my Executor shall sell all of my said estate without any order or decree of court both as regards land and Negros.

6th My will and desire is that my beloved Wife Mary Lanier shall not in any case be compelled or requested to give security for the safe keeping or forced concerning of any of the above named property -------

7th I hereby nominate and appoint my beloved brother William Lanier my Executor to carry into effect & Execute this my Last Will and Testament & I wish it to be distinctly understood that he is not required nor

shall be compelled to give security neither in law nor equity Signed Sealed and Acknowledged in our presence this Twenty third day of June in the year ou our Lord One Thousand Eight Hundred & forty nine & we being unconnected with the testator either by consanguity or affinity & at his special request witness this his Last Will and Testament.
