Two Grandsons File Suit to Revoke Will Of Wealthy Portland Woman

Two grandsons of the late Fannie Emma Malarkey, daughter of a pioneer Portland family who died May 19 at 91, have filed a suit in Multnomah County Probate Court contesting her will which involves an estate of $2,096,612.

The grandsons, J. Huntington and Terrance Malarkey, have petitioned to revoke the will on behalf of themselves and the James Malarkey Foundation and Mary Malarkey Wall Foundation, both non-profit organizations.

Named in the suit as defendants are the executors, Helen Malarkey Thompson, Mary Malarkey Wall and Herbert Malarkey, the Medical Research Foundations of Oregon, Inc., and various family legatees.

Judge William L. Dickson hear testimony Friday of attesting witnesses present at the signing of the will.

Trial Not Set

No trial date was set but Judge Dickson indicated the case would "probably" be heard sometime in March, 1965.
Neither grandson was named as a legatee in the will - and their suit alleges that the decedent signed it without knowledge of the entire content of the document.

Mrs. Malarkey was the widow of James Malarkey, founder of the M and M Woodworking Co., and resided at 1708 SW Hawthorne Terrace at the time of her death.

She was the daughter of a pioneer Portland family and was born in the family home at SW 5th Avenue and Madison Street - site of the original St. Helens Hall and of the present City Hall.

Her father, Charles Holman, operated one of the first transportation companies operating boats on the Willamette and Columbia Rivers. He had come from England and became a citizen in 1856.

Mother Pioneer

Her mother, Mary Emily Huntington Holman, was a member of a pioneer Washington family which came to this country in 1629.

She was survived by three children (the executors) and another son, Huntington - father of the two plaintiffs - who died in 1953.

According to an inventory of her estate filed in probate court, the estate included $1,075,798 in bonds, $785,337 in stocks and $191,303 in mortgages, notes and cash.

Legatees named included St. Stephen's Episcopal Cathedral, $2,000; Trinity Episcopal Church, $1,000, and the Medical Research Foundation of Oregon, Inc., $500,000, to be used for the foundation's Huntington Malarkey Memorial Fund.
