LAST WILL AND TESTAMENT OF JOHN ANDREWS

In the name of God Amen;

I john Andrews of the State of Alabama and County of Wilcox, being weak and in feble health but of sound mind and memory; and calling to mind the mortality of my body; and knowing that it is appointed unto man once to die; do make, constitute and ordain this my last will and testament.

And first of all I give and commend my soul into the hands of Almighty God who gave it; and my body to the earth, to be buried in a decent Christian like manner, at the discretion of my friends and Executors hereinafter appointed. And as touching such worldly estate wherewith it has pleased God to bless me in this life, I give, demise and dispose of the same in the following manner and form to wit.

And first; I direct and it is my will that all my just debts be paid by my Executors hereinafter appointed out of any monies coming into the hands of my Estate; at as early a date as possible ; and after paying my debts; I direct that all the money belonging to my Estate be loaned out on Interest; which interest shall be applied to the support of my wife Lucy Ann Andrews, and the support and Education of my children hereinafter named; and whatever surplus of funds there may be at any time, arising from cash loaned, or the proceeds of crops made on the farm I wish it kept at interest; as far as can be done, for the support of my family as above stated and educating my children. But should the said Inter4est not be sufficient to the support of my family and the education of my children, then it is my will that said support and education be taken from my estate from any funds that may belong to it.

Secondly; I hereby give and bequeath to my daughter Elizabeth Deiaclemid Andrews one negroe girl named Affa about eight years of age.

Thirdly; I give and bequeath to my son Benjamin Boyd Andrews one negroe girl named Fanny about five years of age.

Fourthly; it is my will and I hereby direct that in the event that my wife Lucy Ann should bear to me another child, with which it is probable she may now be pregnant; that child be placed on an equality with my other two children above named; and that my executors take and use from the funds of my Estate, a sufficient amount to purchase a sound(?) negro equal in value to either of the two above bequeathed to my two children Elizabeth and Benjamin and the title be made to the said child. The provisions made in the first item of this instrument is not by any means to affect this fourth and last bequest and should my said wife prove not to be in the state of pregnancy and should she not bear me another heir, then and in that case this last bequest null and void.

Fiftly; It is my will and desire, and I so direct, that the remainder of my Estate not included in the above bequests, both real and personal of every kind and nature, be divided as the laws of the State of Alabama direct between my wife Lucy Ann Andrews, and my children above named Elizabeth Deiademid and Benjamin Boyd and should my said wife bear me another as specified in the fourth item.

Sixthly; It is my will and I hereby appoint my three brothers James W. Andrews, George R. Andrews, Henry M. Andrews and my friend A.C. Ramsey Executors of this my last will and testament.

Finally; I the said John Andrews declare and publish this as my last will and testament hereby revoking all others by me at any time made or assigned.

In testimony whereof I have hereunto set my hand and affixed my seal this twenty fifth day of February in the year of our Lord One thousand eight hundred and fifty four and of the Independence of the United States of America the seventy eighth.
