Confederate Brigadier General. A planter, he was elected to represent Rusk county in the Texas legislature and served from 1859 to 1861. At the beginning of the Civil War, he raised an infantry company at Henderson and was elected its captain. When he discovered that the state orders called for a cavalry unit, he secured the horses and turned his unit into troopers. The unit became company B of the 3rd Texas cavalry. It served under General Ben McCulloch in Arkansas and Missouri during 1861 and 1862. Cumby fought in the Battles of Wilson's Creek and Pea Ridge and distinguished himself in combat. When the 3rd was reorganized on May 20, 1862, Cumby was elected its colonel. Soon thereafter, he resigned his commission and returned home because of bad health. In 1864, Governor Pendleton Murrah of Texas appointed Cumby a brigadier general of the 4th Brigade of Texas state troops. He commanded these reserve forces until the end of the war. After the war, he ran a grocery store in Sulphur Springs, Texas.
