On 30 Sept 1867 Richard and Arabella (Boyd) Kirby were charged with adultery (See: The State 886 vs RL Kirby, The State 887 vs Arabella Kirby, The State 887 vs RL Kirby Arabella Kirby, The State 973 vs JP Barclay). Arabella "Belle" had been married to Richard's nephew, Thomas John Hawkins Kirby but Thomas died in 1862 from complications of a wound received during Civil War.
Belle and Richard had 5 children together. Joseph (b. abt 1865), William (b. 14 Mar 1866), Foster (b. 14 Feb 1869), Joshua (b. 4 Jul 1871) and Ella (b. 4 Mar 1873). The 4 older children are listed with their mother "Bell" in the 1870 census, Perreys, Jackson, Alabama and all 5 are listed as the children of Richard L Kirby in the 1880 Jackson County, Alabama census.
