According to a coroner's inquest, he was accidentally shot in a scuffle. The other person was exonerated during the inquest, which was held August 30, 1940 at the Jefferson County courthouse in Boulder. He died 12 miles east of Jefferson City in a cabin.
I have been researching my family history based upon the limited details of my grandmother Betty (Buckley) Strong (Great Falls, MT). Daughter of George (1891 - 1958)and Marie Buckley (1900 - 196?).
My grandmother used to tell me about the trips she would take with her mother to go see her grandfather in Jefferson City and that it would take 3 days by wagon to get there because they did not own a reliable car at the time. My grandmother told me my Great Grandfathers last name was Dever, she may have told me long ago what his first name was but that was over 30 years ago. She also told me he was killed in Jefferson City (shot in the back over a mining dispute by one of the partners). I believe I have found my Great Grandfather based on the basic information that indicates one of his daughters to have been a Mrs. G. Buckley.

Betty Buckley, My Grandmother 1923-1986
Grace Buckley - Halter 1915-2000
Clyde Buckley 1916-1983, his twin was still born.
Charlie Buckley, USN WWII Veteran (USS Enterprise)
William "Jack" Buckley, USMC WWII Veteran - Injured and permanently Disabled at Tarawa.
Carl Buckley, USN WWII Veteran (USS Enterprise)- My Favorite Uncle 1924-1993
Paul Buckley, USN WWII Veteran (USS Enterprise)- Farmer out side of Monarch and Nye Montana. 1921-2005
