It's the second time 34-year-old Roy Lee Ward could be condemned for the July 2001 killing of Stacy Payne in her Dale home.
A Spencer County judge sentenced Ward to death after a jury found him guilty of murder, rape and criminal deviate conduct. But the verdict was overturned by the state appeals court because of pretrial publicity.
The case was moved to Vanderburgh Superior Court, with a new jury coming from Clay County near Terre Haute.
Defense attorneys argued that Ward should be spared the death penalty because he is mentally ill. The prosecution argued for execution, saying Payne was mutilated and tortured.
