Ben was the son of Joseph Peyton Hays and Amanda Drake (Bowen) Hays.

Ben and Isola "Bird" (Lewis) Hays's child was daughter, Elizabeth Norris Hays.

On December 31, 1910, Ben married Eula Wells. Their children were: Wilson "Lee" Hays, Benjamin Franklin "B.F." Hays, and Eula "Mercedes" Hays. Ben's wife died in 1919 while giving birth to their daughter, Mercedes.

His boys, Lee and B.F., were raised by his sister, Cynthia Miriam "Mayme" (Hays) Grinstead and her husband, Will. Ben's daughter, Mercedes, was raised by his brother Henry "News" Hays and News' wife Lura (Wells) Hays. Lura was the sister of Eula (his deceased wife).

Ben was a mechanic and driver for a station in Tipton, Moniteau County, Missouri.

On February 28, 1921, Ben married Mrs. Nell (Wright) Lietzke; who was born on November 26, 1890.

According to his 1942 World War II Draft Registration, Ben was 5"9" tall, had hazel eyes, black hair and a ruddy complexion. He was also listed as having the end of a finger missing on his left hand.

Ben died at the University of Missouri Medical Center, Columbia, MO. He had both legs amputated and had been living at Kidwell Rest Home, Versailles, MO.
