The accident occurred after Officer Joseph Gray and other officer's had begun drinking beer in the station's parking lot after night shift ended. Gray, 41, drank for more than 13 hours prior to the accidents, Gray and other officers begin drinking in the 72nd Precinct Parking Lot, continued drinking at local Strip Club, a strip bar which officers are forbidden under departmental policy to enter until around 9pm that night. Hours later, Herrera and her family were crossing the street in Sunset Park area in Brooklyn, when drunk driver officer Joseph Gray minivan struck the family after he ran the red light, killing 8 months pregnant Maria Herrera, 23, her son Andy, 4, and her sister Dilcia Pena, 16. All three victim died Aug 4, 2001.

Gray a 15 year veteran, has been suspended without pay. since the incident, 17 officers have been fired, transferred, suspended or restricted to desk. Gray charged with multiple counts of manslaughter, vehicular man-slaughter and driving while intoxicated. Gray had a blood alcohol content .16, well above the legal of .10, when the accident occurred Saturday night. Maria Herrera baby boy was delivered in a emergency cesarean section after the accident but later died and the baby boy is buried in his mother's coffin.

On May 23,2002, former officer Joseph Gray, was convicted on four counts of man-slaughter as well as driving while intoxicated. Gray sentence of five to 15 years for killing a family while driving drunk in Brooklyn, Gray will be eligible for parole in five year.
