OBITUARY :
SHARPSBURG MAN CHARGED WITH FATAL SHOOTING

Robert L. Benner, 40, Sharpsburg, today was charged with murder in the fatal shooting yesterday afternoon of THOMAS W. BRASHEARS, 69, Sharpsburg, and was remanded to the Washington County Jail. The warrant was sworn to by Deputy Sheriff Michael Farrie.

Benner, after firing two shotgun blast into the chest and neck of Brashears late yesterday afternoon walked into a Sharpsburg tavern and asked that a call be placed to the county jail to inform officers that " I just fixed the ______."

Brashears, who was a retired railroad worker, was living at the home of Mrs. Mary Benner, mother of the man who fired the shotgun blasts, and the shooting occurred after an alleged argument between Benner and Brashears.

Sheriffs officers here said the argument apparently arose out of a previous episode in which Brashears allegedly chased Mrs. Lillie Price, a sister of Benner, out of the house with a cane.

Mrs. Benner, in a statement to investigating officers, said she had been ill and Brashears had come into her bedroom. At that point Benner came home and walked into the bedroom and told Brashears to leave, which the latter declined to do.

Mrs. Benner said her son then went to the kitchen and got a single barreled shotgun and stood in the doorway and fired a blast at Brashears. The victim did not fall at the first shot, whereupon Benner reloaded the gun and fired another blast which struck him in the neck and left shoulder.

Brashears was dead before the arrival of a physician.

Sheriff's officers said Benner contended that he fired the shot in self defense, but they pointed that this argument is unlikely because the bed was between Benner and Brashears and Brashears was unarmed.

Mrs. Benner told officers that there had been previous arguments between her son and Brashears, and that her son had been drinking when he arrived home.

Deputy Sheriff Michael Farrie was dispatched to the scene shortly after the Sheriff's office was notified. He obtained statements from witnesses.

Joining in the investigation were State's Attorney Hollyday, Deputy Sheriff Leister Isanogle, County Investigator Bruce Spickler and Sgt. J. J. Cassidy, of the State Police detective squad.

Brashears is survived by a daughter, Mrs. Lloyd Shank, Maugansville; two brothers, Samuel and James, both of Sharpsburg, and two sisters, Mrs. Nancy Reel, Hagerstown, and Mrs. Mary F. Magaha, Point of Rocks.

Funeral services are scheduled for Wednesday at 2 p.m. from the Leaf Funeral Home at Williamsport, with the Rev. Richard K. Dixon officiating. Burial will be in the Broadfording Cemetery.

The body may be viewed at the funeral home from 7 until 9 this
evening.
