Cayuga County Clerk's office, Onondaga Deeds, Liber A, pages 263 & 264: On May 8, 1794, William Thompson of the town of Goshun, Orange Co. NY sold to Abraham Cortright of the town of Warwick, Orange Co. NY part of Lot 93 in the town of Scipio (later became part of the town of Venice).

The Petition of Abraham Kortright of the town of Venice in the County of Cayuga respectfully represents:

That Abraham Kortright late of the said town of Venice departed this life on or about the twenty fourth day of March last past; that he made a last Will and Testament and therein appointed your petitioner Sole Executor thereof; that he left Rachel Kortright his widow; that the following are his heirs and devisees, to wit: James Kortright of the town of Burns in the County of Allegany; Cornelius Kortright of the town of Cohocton in the County of Steuben; your petitioner, who are all of the age of twenty one years and upwards; Philip Tremaine, residing if alive near New Orleans in the State of Louisiana, Daniel Tremaine of the town of Venice; Warren Tremaine of the State of Ohio, in the town of Scipio in the County of Seneca; Abraham Tremaine of the same place; Harvey Tremaine of the State of Ohio, William Tremaine of the town of Venice & Maria Tremaine of the same place who are also of age; Gardner Tremaine of the same place and James Tremaine, Maria Moe and Edson Moe of the town of Genoa in the said County of Cayuga who are minors.

That your petitioner is desirous of proving the said last Will and Testament of the said deceased as a will of real estate, and he prays that the proper and necessary proceedings may be had for that purpose. And he also prays that Barnabas Smith of the town of Venice may be appointed Guardian of the said minors for the sole purpose of appearing for and taking care of the interests of the said minors in the proceedings in this matter.

Last Will and Testament of Abraham Kortright:

In the name of Almighty God I Abraham Kortright Senior of the town of Venice in the County of Cayuga and State of New York do make and publish this instrument to be my true and only last Will and Testament, being advanced in years but nevertheless possessing a sound and disposing mind and memory, under the blessing of a kind Providence.

And whereas my son Gardner Kortright, late of the same place, has recently departed this life intestate and in an unmarried state, leaving me his sole and only heir at law, and the said Gardner being at the time of his decease seized of a real estate, situate, lying and being in the present town of Venice, and is more particularly known and described as being a part of lot number ninety three in the original township of Scipio, being a part of the lands of which I was formerly seized, and have in due form of law, conveyed to my several and respective children, according to the several deeds, reference to the same will more fully appear. And the said Gardner being the time of his said decease, seized in Severalty of one hundred acres of land, part of the aforesaid described premises, according to his title deeds, as also of the further quantity of ten acres on said lot, being the premises purchased by him in connection with the brother of the said Gardner, the Devisee hereinafter named, the premises of which the said Gardner died seized, contains in the aggregate, the quantity of one hundred and ten acres of land.

Now therefore, I the said Abraham Kortright Senior above named, with a view to provide against any sudden event in case of my decease, and now especially to consummate the intentions and wishes of my said son, Gardner, I do hereby give and devise to my son Abraham Kortright, the younger, and to his heirs and assigns forever, as absolute and indefeasible estate of inheritance in the law the aforesaid one hundred and ten acres of land, as above described and of which he died seized as aforesaid. And I do also give and bequeath to my said son Abraham Kortright, the younger, all the personal property, goods, chattels, choses in action of every name nature and description of which the said Gardner died possessed of, or is any way or manner entitled to.

And lastly I do hereby nominate, constitute and appoint my aforesaid son Abraham to be the sole and only executor of this my last Will and Testament.

In Witness whereof, I the above named Abraham Kortright, Senior, have to this my last Will and Testament, subscribed my name and affixed my seal this twenty sixth day of December in the year of our Lord one thousand eight hundred and thirty one.
