Heart Attack
Fatal to Man


A sudden heart attack caused the death late Sunday afternoon of John Bodenhamer, age 76, well known farmer four miles west of Ellettsville. His death occurred at the home of his daughter Truly Adams, 1009 west 6th street, where he had stopped for a short visit while en route to Bedford to visit another daughter, Mrs. W. E. Clark.

The aged man had eaten his Sunday evening meal and was seated on the front porch with Mr. and Mrs. Adams. He complained of feeling ill and went inside to lie down. His condition rapidly grew worse and death came in a short time. Dr. Ben Ross, county coroner, examined the body and pronounced death due to a heart attack. Mr. Bodenhamer had been in ill health for some time.

He had lived in this county for a number of years and had followed farming all his life. He was a member of the M. E. church at Heltonville.

Surviving relatives are the widow, Mrs. Katherine Bodenhamer; five daughters, Mrs. Truly Adams, Mrs. Mary Cummings and Mrs. Isis Mercer of this city, Mrs. Hattie Hall of Ellettsville and Mrs. Maude Clark of Bedford, and one son, Clint Bodenhamer of New Mexico.

Funeral services will be held at 10:30 a.m. Wednesday from the Clear Creek church and will be in charge of the Rev. R. O. Pearson of the Fairview M. E. church. Interment will be made in the Clear Creek cemetery.

The body was taken this afternoon to the home of the daughter, Mrs. Mercer, at 520 west 7th street, to remain until the funeral hour and friends may call there.

John W. Bodenhamer, Administrator of Estate of Mary Bodenhamer Files Suit. Against F. D. Norton.

John W. Bodenhamer, administrator of the estate of Mary Bodenhamer today filed suit in the Lawrence circuit court against Frederick D. Norton for $10,000 damages.

It is alleged in the complaint that the defendant on July 16, 1917, was driving a high powered car upon the public highway two miles north of Bloomington at the rate of thirty to forty miles per hour. That he ran the car around a turn in the road at an unsafe rate of speed and ran against Mary Bodenhamer, who was walking upon the highway.

It is further alleged Mary Bodenhamer was knocked to the highway and her skull crushed. That she was killed by the accident.

The suit is brought by East & East and S. B. Lowe, of this city, and as the plaintiff is protected by insurance the action is really against the insurance companies holding the risk.

Accident on July 16

In which Mrs. Mary Bodenhamer was killed, Cause of Action

Through his attorneys, East & East, of Bloomington, John W. Bodenhamer, administrator of the estate of Mary Bodenhamer, deceased, today filed suit in the Lawrence circuit court for damages in the sum of $10,000 against Frederick D. Norton, of this city, the complaint having been placed in the hands of Attorney S. B. Lowe by the Bloomington attorneys for filing.

The action grows out of an accident that occurred on the Bloomington and Ellettsville road on the 16th day of last July, while Mr. Norton, in company with his wife, were enroute in his automobile from this city to Chicago for a visit with their daughter, Mrs. J. G. Ray. They had spent the night in Bloomington and had just resumed their journey only a short time before the accident occurred. In rounding the curve in the road they encountered Mrs. Mary Bodenhamer, who was enroute from her home to a nearby grocery. She was struck by the machine and her skull was crushed and she died from the injuries in a very short time.

The complaint alleges that her death was due to the careless and fast driving of the defendant.

The fact that Mr. Norton carried insurance on his car to protect him from such accidents, in reality makes the suit against the insurance company rather than himself.

Damage Suit Settled

A compromise has been effected in the damage suite of John W. Bodenhamer against Fred D. Norton, stone quarry operator of Bedford, whose automobile accidentally killed Mrs. Bodenhamer north of this city last July. The husband was paid $2,500. This was paid by a liability insurance company of Indianapolis. Mrs. Bodenhamer was on her way home from a suburban grocery and was walking on the Ellettsville road, when she stepped in front of the car driven by Norton, which killed her.

The suit was filed only a few days ago in the Lawrence circuit court. East & East of Bloomington, and S. B. Lowe, of this city, were for the plaintiff.

Five Stricken With
Ptomaine


Bloomington, Ind., July 29. – Stricken with ptomaine poisonion (sic) while their father lay dead, five daughters of John W. Bodenhamer, Ellettsville farmer, who died Sunday, are seriously ill. They are Mrs. W. S. Adams, Mrs. John Cummings and Mrs. H. V. Mercer, all of Bloomington; Mrs. Hollis Hall, Ellettsville, and Mrs. Everett Clark, Bedford. All except Mrs. Clark are at the home of Mrs. Mercer here, Mrs. Clark, wife of an attorney, is at her home in Bedford.
