Apparently he changed his mind because he mustered into federal service at Camp Ward, Greensburg, Green County, Kentucky, January 10, 1862, as a private with Co. C, 21st Kentucky Infantry. He was left behind sick at Louisville October 1, 1862, in the convalescent barracks and is so listed on the roster until May-June 1863 when he returned to duty as drummer. In November-December 1863, he was detached to duty with the 8th Kentucky Battery, returning to the regiment March-April 1864. Honorably discharged at term's end January 19, 1865, in Huntsville, Alabama.
He died in Carlisle from "chronic interstitial nephritis." His middle initial is often listed as "H."
