Samuel Ailes executed a will the 14th of January 1834. The will was probated 9th of May 1834. As of this date, I do not know the exact date of his death. See file and court house for a copy of part of hsi will, year probated 1834, book C, page 61.
Excerpts from his will: “In the name of God Amen I Samuel Ailes of the County of Muskingum and State of Ohio being aged and infirm but of sound mind and memory do make and ordain this my last will and testament and first of all I desire that at my decease my body may be decently committed to the earth from whence it was taken and my land to him that gave it and as to my worldly effects I will and bequeath as follows towit.
Item #1 I will and bequeath one third of my Estate to my wife Alice as her dower during her natural life or so long as she remains my widow only and no longer.
Item #2 I will and bequeath all my blacksmith tools to my son Stephen as his own and the use of the blacksmith shop till my youngest daughter Aliceann Ailes at the age of sixteen years on condition that he pay fifty dollars on a note executed by me to William Wartenbe due about the 8th November next.
Item #3 It is my will and desire that all my landed property where I now live and my other effects shall remain on the premises and in the possession of my wife for the use of herself and my younger family for schooling until my youngest daughter Aliceann arrives at the age of sixteen years and for the purpose of carrying this my will into effect I give Liberty to my wife, Alice jointly with the other executor herein after named to sell two of my guns towit one rifle and one shot gun as well as such other place property as can be most conveniently shared and apply the proceeds as where as well as to pay for just depts.
Item #4 I will and bequeath my long shot gun to my son Samuel to be given to him when my daughter Aliceann arrives at the age of Sixteen years.
Item #5 It is my will and desire that where my daughter Aliceann arrives at the age of sixteen years that my property then shall be disposed of to the best possible advantage and be equally divided among all my children leaving to my wife her dower as in provided for in the first item of this will.
And lastly I hereby ordain constitute and appoint my wife Alice and my son Stephen Executors of this my last will and testament revoking all other wills by me heretofore made whatsover - in witness whereof I have hereunto let my hand and affixed my seal this 14th day of January in the year of our Lord one thousand eight hundred and thirty four.
