Northwest Quarter of Section 17, Township 33 South, Range 1 East of 6th P.M., being same property devised by John Nickles to Francis Nickles by name of Franziska by his will duly probated and
recorded in will Book 1 at Page 155 in the office of Probate Judge of Sumner County, excepting and reserving from Said Quarter of land 1 acre set apart and used as a burial ground. Party of first part hereby reserving to herself during her lifetime the rents, issues, profits and possession of said land, in Sumner County, Kansas.
The correct name of grantor herein being Francis Nickles.
Deed was dated March 11, 1903, and filed March 11, 1903.
Warranty Deed recorded in Book 103, Page 517, is from Carrie Jordan, unmarried, to Samuel Jones, for the following description:
Northwest Quarter of Section 17, Township 33 South, Range 1 East of 6th P.M., except 1 square used for cemetery purposes beginning at a point 40 rods West of Northeast Corner of said Northwest Quarter, then West 12 rods, 10 feet, 5 inches; then South 12 rods, 10 feet, 5 inches; then East 12 rods, 10 feet, 5 inches; then North 12 rods, 10 feet, 5 inches, to place of beginning, in Sumner County, Kansas.
Grantor covenants that she is a daughter of Francis Nickles, former owner of said land and that said Francis Nickles died intestate and unmarried on the 8th day of February 1905 in Monroe County, New York.
Deed was dated May 3, 1905, and filed May 13, 1905.
A family by the name of Wimer owned this land before the Nickels. A son was buried there, so they thought the cemetery should have been named "Wimer Cemetery." Death notices in 1893 and 1894 in The Monitor-Press give the name as the Clinard Cemetery.
Bert Myers, a nearby resident and overseer of the cemetery for many years, told this story: In very early pioneer days, a wagon train with several families were stricken with either cholera or smallpox. They camped near the location of the cemetery. Several died and were buried there. As was the custom of those days, people who died of a dread disease were buried facing the west.
There are a group of graves in the southwest corner marked only by rocks which seem to be placed that those buried there face the west.
Nothing was ever charged for burial lots. They were reserved and a plat was made showing those reservations.
