John was the son of Thomas Merbury.
He married first Alice Pembridge, the daughter of Sir John Pembridge. They had one daughter Elizabeth.
He married second Agnes de Crophull, the daughter of Sir Thomas de Crophull and Sybil de la Bere.

John Merbury, of Over-Walton, was Chief Justice in South Wales. He had the family estates by inquisition of lands in County Nottingham, Lincoln, Hereford, Salop, Leicester, Bedford and Hertford at the Feast of St. Gregory, 5 Feb. and 4 July Henry VI, 1468.
