Chief Justice Layton was considered a brilliant judge with a strong fundamental understanding of the concepts of the law. Despite his achievements, Layton failed to be reappointed in 1945.

JUDGE LAYTON SR. DIED IN HOSPITAL
Georgetown -- Former Judge Daniel J. Layton, Sr., 80, dean of Sussex County attorneys, died last night in the Milford Memorial Hospital. He had been in poor health for several months.
He served one term as chief justice before the present superior court was set up and had been a practicing attorney in the county and state for 57 years. He was still active as an attorney upon his death.
He was the son of the late Dr. Caleb R. and Anna Sipple Layton of here. His wife died a few months ago.
Surviving are two sons, Judge Caleb Layton III, Wilmington, and Daniel J. Layton Jr., Georgetown; a brother, Caleb S. Layton, Wilmington; six grandchildren, and two great-grandchildren.
Funeral services will be held Monday at 11 a.m. in the St. Paul's Episcopal Church, Georgetown, with the Rev. David B. Mumford, rector, officiating. Interment will be in the church cemetery.
