James was born in Rusk, TX in 1843 to James Scaggs Avera and Mary Walton. James later settled in Sulphur Springs, TX where he owned a mercantile store. James served in 14th Texas Calvary, Co. E out of Hopkins County during the Civil War. He married Sarah Mary Wharton and together they raised 9 children. James became the county clerk for Hopkins County in 1884. He was also very active in the Independent Order of Odd Fellows, a service organization.
