Civil War Union Brevet Major General. In July of 1861, he received authority from the Secretary of War to recruit a Pennsylvania regiment and thus formed the 97th Pennsylvania Infantry Regiment and was commissioned Colonel in command. Promoted Brigadier General in 1862, he led the 97th Pennsylvania the entire Civil War in engagements in Maryland, Virginia and up to the surrender of Confederate General Johnson's Army at Durham Station, North Carolina on April 26, 1865. For the remainder of the war, he commanded the Bureau of Raleigh, North Carolina and was brevetted Major General of US Volunteers for outstanding service.
Col. Guss resigned command of the 97th in June 1864 and was succeeded in command by Lt. Col. Galusha Pennypacker.
