"He died with the bowel complaint and lost the use of one side his head was nearly split open with a sword by Rutherfords men near the Brick House near Wilmington then he was carried to Wilmington put under charge of a Doctor having understood they were going to take Wilmington he sailed round to Charlestown"

According to his daughter's court deposition Neill McPhaul was severely wounded at the battle of the Brick House near the current town of Leland opposite Wilmington, NC. He died and is buried in Charleston, SC. He was wounded but alive on a list of soldiers in Charleston, SC, dated Dec 1, 1781.

He is the son of John McPhaul of McPhaul's Mill and Tavern and his first wife, who remains unknown.
