8 January 1885, Image 1 (excerpt):
Frank Conley, assistant deputy United States marshal brought before Judge Staehle yesterday a soldier from Fort Custer named John Kells, a private of troop I (sic), First cavalry, charged with murder of Joseph Burk, of the same group and regiment. Kells plead not guilty. The murder was committed November 15th, last.

The grand jury at Miles City failed to find cause for indicting John Kells, accused of murdering a fellow soldier at Fort Custer, and he was discharged.

(3rd) Joseph Burke enlisted on October 25, 1881, at Ft. Bowie, Arizona Territory, in Company G, U.S. 1st Cavalry; age 33; born in Dublin, Ireland; occupation, soldier. "Died Nov. 15 '84, gunshot wound at Ft. Custer, Montana Territory, a private."

Joseph Burke, Company G, 1st U.S. Cavalry, was originally buried in section B, grave 5, at Fort Custer, Montana Territory. When Fort Custer was decommissioned his remains were reinterred at Custer National Cemetery, Crow Agency, Big Horn County, Montana.
