1995 MURDER CASE RETURNS TO COURT - AGUILAR WAS GRANTED NEW TRIAL IN 2008 AFTER BEING CONVICTED OF MURDER OF THE CORPUS CHRISTI POLICEMAN IN 1997

"CORPUS CHRISTI — Jury selection started Monday in the trial of a woman accused of shooting her father more than a decade ago.

"Evie Aguilar, 35, was granted a new trial and freed on bond last year, after the Texas Court of Criminal Appeals threw out the conviction of Aguilar in the death of her father, Juan Aguilar, a Corpus Christi policeman.

"Juan Aguilar was shot in the head with a hunting rifle at close range as he lay in his bed on March 10, 1995.

"Prosecutors at the time accused Evie Aguilar and her stepmother, Nilda Aguilar, of conspiring to kill him.

"The state alleged that Nilda Aguilar was furious with her husband over a sexual affair he began with a police department clerk in late 1994, and that Evie Aguilar long had been estranged from her father.

"Juan Aguilar's girlfriend Rosalinda Morales testified that they planned to be sharing an apartment by April 1995, and to be married by the end of that year.

"Nilda and Evie Aguilar say they spent the night together in Evie Aguilar's home on March 10, 1995, after a domestic quarrel resulting in Juan Aguilar's asking his wife to leave the house for the night.

"Evie Aguilar testified that they disposed of the hunting rifle in Petronila Creek 30 miles from Corpus Christi because Nilda Aguilar feared her husband was suicidal. Evie Aguilar testified that she didn't know who shot Juan Aguilar.

"The two women were tried together and blamed each other for the crime. Both were convicted in 1997 of murder and sentenced to 25-year prison terms. Evie Aguilar was granted the new trial in 2007."
