Note: The State of Montana Certificate of Death issued by Park County gives the name of' this person as Earnest Acre, however, the newspaper article about the death gives the name as Ernest Acra.

CRUSHED TO DEATH – YOUNG MAN JUMPS FROM MOVING FREIGHT TRAIN – BREAKY ORDERED HIM OFF – AND HE WENT – LEGS CRUSHED BY TRAIN - DECEASED A RESIDENT OF INDIANA

Ernest Acra, a young man residing at Aurora, Ind., and beating his way west, was run over by a freight train near Miner, west of this city, Monday afternoon and sustained injuries from which he died that night at St. Luke's hospital. Acra was beating his way west with Henry Passon, Paul Bartleson and James Mickelson. He was without funds, and after word was received from his relatives that they were unable to bear the expense of shipment of his body home, the remains were interred in the county cemetery at this place. Tuesday Coroner Leard empaneled a jury composed of AJ. Hamilton, S.L. Holliday, L.S. Price, Daniel De Hart, and the testimony of the three men above named, Engineer Longsbern and Fireman Bloomer and the brakeman was heard. The following facts were brought out:

Henry Passon testified that he was a resident of Aurora, had been in Montana about a week, and left Livingston Monday afternoon. He was an uncle of Acra, who was 24 years of age. Acra was riding five or six cars from the engine, on the rods. Witness was with him. The brakeman chased Acra from the train and he was struck by an east bound, knocked under and run over. He did not see him hurt. He knew he was hurt, however, as he heard him yell. The train was going up the hill, about five miles an hour. Did not see the brakeman. Acra told him afterward the brakeman was on the ladder of the car he was riding. Think it was the east bound train that struck him. Acra said it was the engine of that train struck him. There was not much distance between the two trains, and he stood still until the east bound train had passed. Stub train No. 12 brought the boy to Livingston.

Boy said the brakeman climbed down the ladder and said, three or four times, "Get off, you --- ------! get off!" Witness did not hear it. So far as the train they were riding on was concerned, the boy could have gotten off without injury. It was the other struck him. There is loose gravel between the two tracks, where the tracks are being raised. Paul Burtleson (sic) and James Mickelson testified to about the same facts.

The verdict of the jury as follows: "We, the coroner's jury empanelled to inquire into the cause of death of one Ernest Acra, find that he came to his death on September 20, '09, on RR tracks about one mile east of Muir, Mont., said death being the result of injuries sustained by being struck accidentally by east bound train No. 56, and knocked under wheels of west bound extra, west."
