Hilary, whose father was a mayor of Philadelphia, was a prominent Richmond attorney and civic leader. He married Margaret Marshall Roberts about 1815. They had at least eight children: James Milnor, Mary Louisa, Francis March, Thomas Roberts, Elton, Hilary Jr., Anna Knapp, and Charles Tolbert.

He served as a Private in the 19th (Ambler's) Regiment, Virginia Militia, during the War of 1812. He was an uncle to Unionist spymaster Elizabeth Van Lew.

He is buried near his wife and several of their children in the plot he owned. A government military marker, set in front of an illegible private marker, was organized by the "Friends of Shockoe Hill Cemetery" in 2018.
