On August 29, 1857, he married Sarah Elizabeth Wilson in Wilson Co., Tennessee. To this union the following children were born: Samuel Allen, Elizabeth Ann, Isaiah David, Charity Callie, William Thomas, Nancy Malinda, and Jesse Sylvester Burks. Sarah and William were divorced on October 24, 1893 in Taney County, Missouri. He served during the Civil War with Company K 10 Tennessee InNf. From 1884 until 1894, he was the probate judge for Taney County, Missouri.
