Promoted to Captain and commander of Company H on October 4, 1862, he led his men through to the July 1861 Battle of Gettysburg, Pennsylvania. There, while his men were fighting in the Rose Woods area on the Second Day of the Battle (July 2), he was wounded in the thigh. He lingered with his wound in Gettysburg until he died on July 29, 1863.
On September 12, 1863 his wife, Ellen A. Davis, filed for a US Army Widow's Pension (Application #32897, Certificate #14450).
