He served in the 3rd New York Volunteer Cavalry until April 3, 1862, when he was transferred to the 1st New Jersey Volunteer Cavalry, and was mustered in as a Private in Company L (New Jersey Adjutant General records list his name as "James Avoy").
During the August 1862 Second Bull Run Campaign, he was captured by Confederate troops under General Stonewall Jackson while guarding trains at Manassas Junction, Virginia.
Eventually exchanged, he re-enlisted and served through the conclusion of the conflict. He was honorably mustered out on July 24, 1865.
He married Ann Hard Chevalier on October 14, 1874 at St. John's Evangelical Church in New Brunswick, New Jersey. They had 11 children.
