UPDATE 3/1/13 @ 7 p.m.
LOGAN COUNTY, W.Va. (WSAZ) -- A freak accident ended with a young man dead. A tree fell over the road, hit a man's truck and killed him.

"As the tree was coming down, he was right underneath of it," West Virginia State Police Trooper Marcus Broadwater said. "Pretty bad timing, I don't think there was anything he could do to avoid it either."

Adkins, who was just 29 years old, was on his way to his new career as an attorney in Logan. He also was engaged recently.

Thomas Staggs says he's devastated for Adkins' family because he knows it easily could have been his own.

"We're up and down this hill six to eight times a day, me and my family," Staggs said. "My granddaughter went to school about 7:15 this morning. She drove off the hill here."

Staggs remembers another accident several years ago about a quarter of a mile away.

Police say that's when a tree fell on another car, also resulting in a fatality.

As for this accident, Staggs says it has never stood on sturdy ground.

"It wasn't on top of the bank. It was just out of the side of the bank," Staggs said.

It's unclear who owns the property where the tree stood or what caused it to fall.

However, investigators say it looks like the dirt was loose there, which was likely caused by weather conditions.
