Colonel Rives was wounded during the battle of Elkhorn Tavern, Pea Ridge, Arkansas, on March 8, 1862, and died of his wound the next day. Colonel Rives was promoted to Brigadier General subsequent to his death. It is not known whether this promotion was posthumous, or whether the commission simply reached him after his death.
