Infant Hoss Wayne Benham of Cullman passed away Tuesday, March 11, 2014, at the age of 1 year. He was born March 11, 2013, in Cullman to Brody Wayne Benham and Crystial Ballenger.

Funeral services will be at 2 p.m. Monday, March 17, at Moss-Service Funeral Home Chapel, the Rev. Chuck Kennedy officiating, with interment East Point Cumberland Presbyterian Cemetery.

Survivors include his father, Brody Wayne Benham; mother, Crystial Ballenger; grandparents, Glenn and Christine Welch, Diane and Anthony Benham.

Crystial Ballenger pleaded guilty to felony murder in the death of Baby Hoss, her son. The charge was reduced from capital murder of a child under 14 years of age, preventing a possible death sentence. She received a 40-year sentence in state prison, equal to that of her co-defendant Jeffery Hugh Brown who was her boyfriend at the time.

Baby Hoss' injuries were detailed in court records; however, due to their heinous nature, they will not be printed here. By pleading to felony murder, the other charges were sadly dismissed.
